EEOC Releases Final Rule Implementing ADA Amendments Act of 2008


Since the ADA Amendments Act of 2008 (“ADAAA”) was signed into law by President Bush on September 25, 2008 and became effective on January 1, 2009, employers have been waiting for new implementing regulations to be issued by the Equal Employment Opportunity Commission (“EEOC”).  The EEOC issued proposed regulations during the last quarter of 2009.  On March 24, 2011, over a year after the proposed regulations were issued and after review of more than 600 public comments, the EEOC published the Final Rule implementing the ADAAA.  In addition to the Final Rule, the EEOC also posted on its website questions and answers and a factsheet explaining and illustrating changes in the Final Rule and the implementation of the ADAAA. The Final Rule was published in the Federal Register on March 25, 2011.  Links to the information published by the EEOC regarding the Final Rule are below.
